I fail to see where it states that you are exempt from a violation if the approaching vehicle is speeding. Maybe I need to dig a little deeper.

Inexperienced driver is my view. She either never saw the vehicle coming (I hope for her sake) or she saw him and didn't think twice of it and thought she would have plenty of time to get through the intersection.

Let me try to put it into a different point of view also. Lets say the motorcyclist was driving a car on an icy road at 50 mph. A car approaches an intersection, stops and has a visual on said vehicle. Car at intersection has plenty of time under normal circumstances but it is icy that day. Car pulls out, cannot get traction and pulls out in front of the oncoming vehicle and cannot clear intersection do to ice. Who is at fault here?????

P.S. the reason I will not ride a bike in this town, use to ride them a little in HS, too many close calls in the late 80's. A hell of a lot worse now...

P.S.S. also saw where it states if you flee from officers, first offense misdemeanor unless fleeing from a felonious act.. 24 points though

Authorities are still investigating the crash, but say at this time they do not intend to cite Kenney. “Plenty of evidence at the scene” indicates that Lahr was speeding while heading north on 25th Street South before he struck the black Cadillac Escalade, Fargo police Sgt. Jeff Skuza said. Skuza declined to say how fast Lahr is believed to have been going. The posted speed limit is 35 mph. Court records indicate that Lahr has four speeding violations since 2005, including an April violation for going 48 mph in a 30 mph zone in Clay County. “We have reliable info that she was at a complete stop and that she used a reasonable speed to pull out into traffic,” Skuza said of Kenney. Kenney, who has a driver’s license, and her passenger were not injured, he said.

And honestly, thats probably where it's going to be left at. Is there more to the story? Very well could. Did Kenney do anything that MAY have HELPED cause the accident? Possibly. We will never know. She and her friend are the only people who are going to be able to tell us that, and I honestly doubt she or her friend would admit something like that when there was a death in the accident.

She has to live with the fact that the accident she was in, a death occured. Thats a big enough punishment in itself. I don't think they should cite her for it if this is the info they have. She will have thoughts, nightmares, and everything else about this 1 moment in her life.

Best wishes to Lahr's family and best wishes to Kenney, her family, and the friend.

no...I doubt she'll lose any UNLESS she did actually flee the scene, which I don't know if it is true or not.
