The issue isn't whether he won or not, the issue is whether or not he violated his probation.

I don't see how buying a lottery ticket would affect his probation. I can understand if he was in a bar playing pull tabs or in a casino but he was in a grocery store.
Well at least he won't need to rob any banks if he gets to keep it and will probably better himself. On the other hand if he doesn't get to keep it he will most likely be a low life and rob again.

the whole deal with his probation is that he can't gamble. so he gets to go be institutionalized.. and probably won't get to keep shit. i'm sure they'll say "legally he wasn't supposed to be buying lottery tickets" and make a deal with the lottery.. and then he'll get to sue.. and they'll spend ten times more than anybody ever needs to on court costs, because the guy thought he was special and violated his probation.

If part of his probation deal was "don't rob banks" and he did it again.. would you say "let him keep the money, he got it with no deception at all"? heh.

Let the court figure it out. I wouldn't even want to deal with ruling on this one.

let him keep it and then punish him, or atleast let him keep part of it then some could go to courts or somthing of that nature

I'm with you, unless the lotto ticket thing was covered expressly in his probation terms. If it just says gambling, I don't think of lotto tickets as gambling. At least in purest sense of the word.

from the article linked in the first post.

Under terms of his probation, he "may not gamble, purchase lottery tickets or visit an establishment where gaming is conducted, including restaurants where Keno may be played."

                      answers that question. reading FTW!

                      haha.

Yeah I read it but that doesn't mean that it is written in his probation terms. I guess if you put quotations around anything that make it true. Thinking FTW.

fixed. heh. i'm not gonna try to go dig through his court paperwork, but the way I take their quote, it means it was actually under his probation terms. Assuming they properly quoted from his probation terms, and reported it correctly (which is assuming a lot from the media today).

we should have a pissing contest sometime. I'll come over to the store, and we can do that. it'd be awesome. no, seriously. i'll stop by. =D

i wonder if this case has gone to court yet. be interesting to find out what happens, at least. bet you a dollar's worth of gas he loses the money.
