      Just a little info, the general contractor may not have been the one to do the signing on the project, even though they are responsible. That portion of the job may have been sub-contracted out. More than likely if it was they would have had their name on the back of the sign. Sometimes the contractor may just rent the signs and maintain them themselves or have the others take care of placement and maintenance.

      City of Fargo Construction Specifications state;
      All devices and methods of traffic control shall conform to the Manual of Uniform Traffic Control Devices.

      That states that they must be secured with ballast to withstand winds, must use sandbags.

      Get some picts of the other signs that were not blown over, more than likely they are secured the same way and contact them directly and asked how they would like to correct the problem

        signs had 3-d specialties stickers on them. we told the cop on the phone that the signs were not sandbagged down, she just kept giving us the act of god speach.

          wait, you told them on the phone? officers don't answer and you won't speak to one unless you specifically request it. those are dispatchers, plain-jane dispatchers. i don't know how much training they have in law, but i wouldn't trust their word over an officer. without being a lawyer, judge or policeman, i think they have to come over if you decide it's necessary, YOU are the tax payer that pays for civil protection.

          worst case, i would ask them to listen to the call recording to find out that this dispatcher would not send an officer, that would likely give you some leverage in your fight for your right to the damages caused by someone else's negligence.

            Often times you call the police station and they have an officer call you back.

              I would see what your insurance company says first. The company that is responsible for securing the signs might not fight it at all.

                Time for me to jump in on this one. I work for 3-D Specialties and I know we went out last week when the wind started picking up and put extra sandbags on every skid for every sign that we have out right now. That means either: 1. Someone stole them(not uncommon), or 2. The construction company actually doing the road work moved them. This is not 3-D's fault. When we put anything up there is a minimum of 6 bags per sign.

                    We usually have one person on maintenance over the weekend. Plus, if there were only 6 bags per sign, sudden 70mph winds like what we had last night are indeed going to take signs out. I have seen signs with 8+ bags taken out by 50mph gusts.

                      this wasn't the sudden 70 mph winds of the second storm, these were the 30 mph winds of the first storm.

                            btw, the wind is an "act of god", rain is an "act of god" hail is an "act of god". i would have told the dispatch to eat shit, ahe would have done the same thing if her vehicle was hit by a sign.

                            the correct term for you problem is a tort of negligence, meaning negligence is a tort which depends on the existence of a breach of duty of care owed by one person to another.

                            so the contractor in this case is liable for the sign being secured SAFELY. but obviously the negletced the fact that winds might pick up a FLAT SHEET like a screen door in the wind. in their negligence they are now liable for damages done to your vehicle.

                            google tort law. and defend yourself. i hope this helps

                              One last bump due to the fact that someone that works for the company knows about the problem and yet the signs are still not sandbagged down, they're just free standing on the sidewalk now.

                                  TSS and United Rentals dont exhist anymore---TSS was bought by United Rentals like 6 years back and was called United rentals highway technologies, United Rentals sold the company to Northstar Saftey so now the signs would say NSI on them (i only know this cuz my dad works for Northstar Saftey--previously TSS&URHT) lol
