City of Mhd. property damage?

So the city (qwest) has been laying new lines and they happen to be doing work in our backyard. We went and looked at the hole because my mom has a garden back there. There is a 10 foot easment from the ditch and they have the other easment from the road marked with flags as well.....20 feet i think it is though im not sure. Anyways, we looked and saw that the extreme tip of the garden is on the edge of where the 2 easements meet and the rest is our property. We looked and the whole garden was walked all over as well as tractor damage to our yard about 4 feet past the easement lines. Would you guys say we should pursue something with the engineer (he called us a week before and told us to call him if we have any problems). The damage to the garden was NOT easment property, it was OUR property, as well as the damage from the blade of the tractor. What do you think we should do??
Sort of bad picture but it conveys the message, our property is in yellow and slightly in front of it, basically the hole they dug is RIGHT on the line.

I would suggest checking with the engineer, since he said to contact him if you had any problems, he would be likley to work with you out of nothing more then kindness. beyond that you may run into problems trying to take alternative courses of action. I am not certian as of moorhead municipal codes but there may well be a clause in there about anything with in so many feet of the property line. the city tends to have juristiction over the property line and all land connected immediatly to it. hense fourth why if you errect a fence it has to be a certian distance from the line on your side. I would think though if you speak kindly to the project manager for this particular project he would be of the most help to you. either way the damage to the property was ascetic. from the looks of the picture all they did was relocate some soil.
either way best of luck on your fight here. you have right on your side, but unfortunatly you may not have the letter of the law. just my take on it though.

wait until they are done and make them come back and sod it. the city of moorhead ends up doing it to our yard nearly every spring.
