actually, I believe ND law says you can't smoke within 50 feet of a non-smoking establishment....this is off the top of my head, so i can't remember for sure. Also, by moving (drunk) people away from their property, should a fight break out amongst those smoking (or those complaining about smokers) it is not their problem as they are off the property.

Smoking indoors is banned in Hennepin county, period.
On March 31, 2005, a smoking ban went into effect in Hennepin County that prohibited smoking in indoor areas of restaurants and bars. Ordinance #24 protects the health of the people of Hennepin County by creating a smoke-free environment in all licensed food and beverage establishments. The ordinance prevents the exposure of second-hand smoke to both patrons and employees of food establishments, thereby protecting their health. The ban was modified slightly in December of 2005 to exempt stand-alone bars and private clubs. Less than 1% of the establishments in Hennepin County are currently exempt from the ban.
