    If you are larger, it will simply take more alcohol to raise your BAC to the same level as a smaller person. It doesn't necessarily mean that you are not as impaired as a smaller person at the same BAC.

      Oh, and the blood test is much more accurate than the breathalyzers.

        I thought that the punishment is more severe if you refuse a breathalyzer. Any truth behind this?

          There is a difference between refusing a breathalyzer and requesting a blood test over a breathalyzer. If you "refuse" both tests they can charge you with other offenses as well and then will test you anyways regardless of your consent. If you specify you want a blood test they will just put you in a police car, bring you to the station, and have your blood tested.

              How so? They make you take a shot and sit for 15 minutes before you have a blood test or what?

                  No, the chemical process that they go through during the analysis requires that a small amount of alcohol be entered into the blood sample....not sure why it is this way, just going by what attorneys have told me.

                    thats kind of strange. do they compensate the test for the alcohol they added or something? seems like they should do something of the sort if they are knowingly adding it

                        Interesting. Do you have any more information on how the blood test is performed?

                        Personally, I would trust the results of a blood test before I would trust a breathalyzer.

                          I should note that the test process in MN and SD do not use this protocol (from what I have heard) so in those states I'd suggest you consult your attorney prior to ANY test.

                            I'm just gonna go in and take my medicine thursday. I'll probibly call the prosecutor and see if I can bluff my way to a reduction. Its worth a shot. My car will be off the street for 4 weeks tops so i will just have to be extra cautious when I go to work and not get pulled over, unless someone has a scooter they are willing to borrow me. lol

                              I just fiqured my mileage again and with the new oxygen sensors MPG is up to 15 in town 25+ on the highway. WOOT

                                    I almost forgot...getting caught driving without a liscense will cost you about $300 in fines, an extended period of revocation, and GUARANTEED jail time. It's definately not worth it.

                                        And it's FUCKING ANNOYING when you're in court and there are 40 people in front of you being charged with "driving under suspension/without a license"
