FARGO - Police say one of the suspects in a drunken rampage in which two cranes were used to smash part of a hockey arena construction site has confessed to investigators, telling them to "flip a new page" and take his story.
Jordan Lugert and David Vacha, both 24, of Fargo, made their initial court appearances by video Friday in East Central District Court.
A third suspect, MacArthur Johnson, 21, of Fargo, was arrested Thursday.
The damage estimate from the vandalism currently totals about $750,000, said Tristan Van de Streek, an assistant county prosecutor.
"Obviously this is a very serious case," Van De Streek said.
Lugert is charged with criminal mischief and two counts of unauthorized entry into a motor vehicle. Vacha is charged with conspiracy to commit criminal mischief and two counts of conspiracy to commit unauthorized entry into a motor vehicle. Officials said the unauthorized vehicles refer to the two cranes at the site.
A police affidavit said Lugert told investigators he and Vacha were "extremely intoxicated" when they went to the building site at about 4 p.m. last Sunday. Lugert said he operated the cranes, both of which caused extensive damage.
Lugert said he threw a brick through a window of the driver's cab on one of the cranes to get inside, the police affidavit said. While he was moving the boom on that crane, the large metal ball on the crane's cable hit the cab and crushed it, the affidavit said.
Lugert said he later went into another cab and started operating the boom. He said he heard a screeching or creaking noise and realized the boom had bent one of the large steel beams in the roof. Lugert said he ran from the arena.
Police were led to Lugert and Vacha after a tip from a man who believed that one of his employees knew what happened. The employee told officers about a party Saturday night at Lugert's apartment, which is near the Urban Plains Center. The employee also said Vacha was known to visit construction sites and try out equipment.
Lugert told police the first thing he and Vacha did was climb on the roof and push a large generator off the north side of the building. Vacha took a fire extinguisher and wrote the word "yeah" on a wall, the police affidavit said.
Lugert told investigators that he and Vacha were drinking Hamm's beer - and police said they found Hamm's beer cans at the site.
Vacha refused to talk to police.
Lugert's lawyer, Mark Beauchene, said his client works full-time as a warehouse trainer and attends school at Moorhead Tech, where he maintains a 4.0 grade-point average. Lugert is a member of the Army National Guard and served a tour of duty in Iraq, Beauchene said.
"He has no criminal history. He's a minimal flight risk," Beauchene said at the bail hearing.
Judge Douglas Herman set bail Friday at $10,000 for Lugert and $30,000 for Vacha. Both were ordered not to use alcohol.
Van de Streek said he asked for a higher bail for Vacha because of prior criminal history that includes disorderly conduct and criminal mischief.
Police said Lugert's confession was not taped because the digital recorder batteries died during the interview with investigators.
Lugert told police that Johnson and Vacha had gone over to the Urban Plains Center on Saturday night. Johnson is expected to appear in court Monday. He faces charges of criminal mischief and criminal conspiracy.
Vacha asked Judge Herman to appoint him a public defender.

An example of the stupidity people will do, im sitting in the garage, 3 or four younger black kids and a 15ish year old white girl come over to the appartment building im in, from theirs, for no apparent reason other than to sit on the front entryway, one of the boys proceeds to pull out an airsoft pistol, while im watching nonetheless, and shoots at the porch light glass! and casually walks away, back to his appartment complex.

I know both of those guys... used to hang with them until they were acting like a bunch of tools. Hopefully this gets both of them off the sauce... i doubt it though. Lugert is a good guy... his girlfriend was FINE back the day. I about died when i saw their faces in the paper.

yeah, make sure you do something to the keyhole, most of them are threaded behind them, use a big washer and then a thin nut to secure it to the garage, i had to do that at my last apartment, someone broke the plastic off and popped the key hole out, touched the 2 terminals together and up the door went. thats just what i did, and works great.

if you've got one of those switch locks, secure it with a washer or plate and a nut (stop by a locksmith, they have hundreds, they're a standard size) or tie the wires off on a screw/nail/whatever inside the garage so the wires don't follow through to the outside if somebody does pull the lock out. We had somebody in my building, their lock was pulled out, and the guy stuck a hanger in there to get to the wires.. ended up hitting the switch for the power to the garage. totally screwed the guy whose car was in the garage.. think it was stuck in there for about a week before the garage door company stopped out to fix everything. :drunken_smilie:
