    sounds like the driver wont be at fault for this because the kid "did not cross at a designated intersection". the article on the forum website also said he suffered a broken leg.

          I saw a 10 year old boy get taken out by an Escape earlier this summer. That shit is scary to actually see happen. I hope this kids okay.

            any pictures?, I hope the kid pulls through, something like this happened in AK when we were there, turned the whole town upside down because the kid died....

                ^^ yea the van was messed up but its sad to see stupid shit like that happen. And how his parents are feeling that must be alfull.

                  so.. whose "fault" was this? did the kid dart into the road, or did the van just pull to the right and smack him for no reason? I'm glad the kid's alive.. and it would certainly suck to be either person involved. but I still don't know the whole story here, so I'm not sure which person to call stupid. ..because usually in anything involving a car hitting something or someone, there's somebody involved who ate a bucket of fried stupid for lunch. i just wanna know who it is.

                    i was reading something a while ago that said when something like this happens that is the drivers fault in all cases. failure to maintain control of the vehicle is what they called it.

                      according to law enforcement charges will most likely not be filed because the kid on the bike did no cross at a designated crossing area.

                        yeah.. there's legal fault, then there's common sense fault. huh.

                        Pedestrians technically are always supposed to have the right of way.. right? Even when they just step out in front of your car, you're supposed to get in trouble for hitting them.. it still sounds to me like the kid just darted out into traffic and got himself hit. Which sucks for him.. sucks for his parents.. sucks for the lady who hit him.

                        So can this be a lesson to everybody, pay attention to what's going on around you while you're driving? Call me fucking paranoid, but I've had enough near misses while driving that wouldn't have been misses if I hadn't been paranoid about just about everything.

                            I heard he was 19, He apparently just rode his bike into traffic without looking, and got creamed. broke both his legs.

                              His name is Jamie and he is 18 I believe. He lives 2 houses down from me, and his bike is still sitting in my garage. Jamie was adopted by a very nice woman who takes in a lot of very troubled and handicapped kids from 7 months to 17 years old. Jamie was a fetal alcohol syndrome child and has fought real hard do make the best of the cards he was dealt. He and his brothers and sisters all hang out and "help" me in the garage, they are all great kids. Jamie is not the brightest kid, but he is extremely fit, and had a good job with deckmasters. He never rides that bike less than as fast as humanly possible and did cut out of the Bluemont enrty right in front of the van on 25th. I yelled at his brother and sister both only hours before the accident for riding in the street. We all kind of expected this to happen one day as people drive like crazy down our street to cut through to university from 25th and we have many kids within just a few houses. Jamies mother immediately told the police no charges were going to be filed, its just the way she is. The woman in the van had no chance to avoid him and was terribly shaken up. Jamie has 2 very badly broken legs, a punctured lung and they are keeping him a few extra days due to irregular heart beat. The other kid involved was his younger "brother" Andy who is also an adopted child from another family who luckily wasnt able to keep up to Jamie on rollerblades. So thats the story.
