    no offence. but seriously there are PLENTY of places that do not allow smoking. why not go there???? Like I stated I personally do not mind going outside (as a smoker) But I just think there are plenty of places that allow and don't allow smoking where there shouldn't be a problem.

                            No, it is a privilege. Driving a car is a legal thing to do....but it is a privilege as well. Free speech/expression is a right, so long as your as your speech/actions do not infringe on the rights of others. Even with rights, there are limitations.

                            To further clarify: The right to free speech is a right, but to hear my opinion is a privilege.

                                Rights are not "granted" or given to people by their government, we are born with them. Rights are unalienable because they are endowed in every person by their creator, or if you would rather, by nature. Other than God, there is no higher authority.

                                You do not need permission to exercise rights. This is significantly different from a privilege where permission from a terrestrial authority is required.

                                People often make the mistake of thinking that the Bill of Rights lists the rights government gives you. This is not true; the Declaration of Independence makes it clear that the rights come from the creator, not the government. Also the Ninth Amendment makes it clear that there are other rights not enumerated and, like all rights, they fall under the jurisdiction of people.

                                The government, on the other hand, has no rights, only the privileges that we, the people, give it. We, the people, created it. It cannot dictate to us what we can and cannot do, or who we can and cannot marry, no more than you can boss your own parents around.

                                Government exists only to protect your rights. That is why they are listed, so the government knows its job, not so you know what your allowed to do.

                                          A person who isn't smoking doesn't infringe on your privilege of being in the bar. However, a person who is smoking infringes upon other peoples' right to health. Saying "You have the right to leave the bar" doesn't hold any weight, because the non-smoker will just resort back to the same argument.
