Fuck you to the contractor who has been hired by the city to do some work on 13th avenue by the mall. YOUR ROAD CONSTRUCTION SIGNS ARE SUPPOSED TO BE SANDBAGGED/CINDER BLOCKED DOWN TO KEEP THEM FROM BLOWING OUT INTO TRAFFIC. After the first storm rolled through at 5:15 tonight I saw a SHIT LOAD of signs and all of them were still standing except for the 4 on the median that your company put up.

Fuck you to the dipshit in front of us who panicked and stopped in the middle of traffic on 13th when the sign took flight. NOT ONLY WAS THE SIGN NOT NEAR US, IT WASN'T EVEN IN THE WESTBOUND LANE, YOU HAD PLENTY OF TIME TO FUCKING MOVE, BUT NO, YOU HAD TO STOP AND STARE AT IT FOR 15 SECONDS AND WAIT FOR IT TO START TO COME TOWARDS US BEFORE YOU SHIT CAN IT OUT OF THERE, LEAVING US WITH NO CHOICE BUT TO BE HIT BY IT. Thanks to the combination of your shitty driving/decision making skills and my first fuck you I now have a huge gap between my front bumper and grill on the driver's side, a crease in my fender, orange paint/scratches on the front and rear doors, and a huge dent/scrape/missing paint on my rear quarter all on the Tahoe that we bought over the winter.

Fuck you to the fargo police department. My insurance company will more than likely be trying to go after the construction company due to their neglegance. All I asked for was a police report, I just wanted an officer to come down to us so he could see that the sign was in fact NOT SECURED PROPERLY and that the damage WAS CAUSED due to that fact. Thanks for the response of "We aren't able to control the wind, it's an act of god. Sending an officer out to write up a police report would be a waste of the officer's time when we have other issues to deal with. Contact your insurance company and if they need a police report to file the claim get back to us." I for once thought maybe, just fucking maybe you could be on the side of the little guy, you have let me down again. FUCK YOU!

and before anyone asks "why didn't you just change lanes" I'll respond. The other lanes (center and right) were full of people going balls to the wall to get out of there before they got hit by one of the four signs that were blowing around in traffic. I'd rather get hit by a sign then run into someone.

Just a little info, the general contractor may not have been the one to do the signing on the project, even though they are responsible. That portion of the job may have been sub-contracted out. More than likely if it was they would have had their name on the back of the sign. Sometimes the contractor may just rent the signs and maintain them themselves or have the others take care of placement and maintenance.

All devices and methods of traffic control shall conform to the Manual of Uniform Traffic Control Devices.That states that they must be secured with ballast to withstand winds, must use sandbags.
Get some picts of the other signs that were not blown over, more than likely they are secured the same way and contact them directly and asked how they would like to correct the problem

wait, you told them on the phone? officers don't answer and you won't speak to one unless you specifically request it. those are dispatchers, plain-jane dispatchers. i don't know how much training they have in law, but i wouldn't trust their word over an officer. without being a lawyer, judge or policeman, i think they have to come over if you decide it's necessary, YOU are the tax payer that pays for civil protection.
worst case, i would ask them to listen to the call recording to find out that this dispatcher would not send an officer, that would likely give you some leverage in your fight for your right to the damages caused by someone else's negligence.

Often times you call the police station and they have an officer call you back.

Time for me to jump in on this one. I work for 3-D Specialties and I know we went out last week when the wind started picking up and put extra sandbags on every skid for every sign that we have out right now. That means either: 1. Someone stole them(not uncommon), or 2. The construction company actually doing the road work moved them. This is not 3-D's fault. When we put anything up there is a minimum of 6 bags per sign.

btw, the wind is an "act of god", rain is an "act of god" hail is an "act of god". i would have told the dispatch to eat shit, ahe would have done the same thing if her vehicle was hit by a sign.
the correct term for you problem is a tort of negligence, meaning negligence is a tort which depends on the existence of a breach of duty of care owed by one person to another.
so the contractor in this case is liable for the sign being secured SAFELY. but obviously the negletced the fact that winds might pick up a FLAT SHEET like a screen door in the wind. in their negligence they are now liable for damages done to your vehicle.

TSS and United Rentals dont exhist anymore---TSS was bought by United Rentals like 6 years back and was called United rentals highway technologies, United Rentals sold the company to Northstar Saftey so now the signs would say NSI on them (i only know this cuz my dad works for Northstar Saftey--previously TSS&URHT) lol
